Work Camp employee in court for alleged sex with inmate, gets lesser charge

REXBURG — Tina Marie McClure appeared in court today to be arraigned for felony sexual contact with an adult inmate, but came away with a lesser charge.
The 51-year-old Chester resident was a psychosocial rehabilitation worker at the Idaho Department of Correction’s St. Anthony Work Camp. She was charged with sexual contact with prisoner — a 32-year-old male housed at the work camp.
During the arraignment, Madison County Prosecutor Sid Brown requested to amend the felony criminal complaint to misdemeanor battery, with the understanding McClure would plead guilty to the misdemeanor charge. His reasoning was that he did not believe that the woman acted in a predatory manner and McClure has no criminal history.
District Judge Greg Moeller allowed the change.
“The law is clear that these kind of charging decisions are up to the prosecuting attorney, not up to the court,” Moeller said.
McClure’s next court appearance has not been scheduled.
