IDAHO FALLS — The preliminary hearing for Brian J. Mitchell, the man charged with the murder of 31-year-old Deraek Larson, has been postponed for several weeks.
Mitchell, 18, appeared in court during the originally scheduled preliminary hearing Wednesday Sept. 2. with Defense Attorney Trent Grant. Grant requested a postponement to review the results of a recent evaluation presenting new information regarding the case. Mitchell’s defense had filed a motion reset the date of the hearing on Tuesday, Sept. 1.
Magistrate Judge Stephen Clark granted the continuance after asking Mitchell if he understood the time frame change. Mitchell replied, “Yes, Your Honor.”
Mitchell is charged with the second-degree murder in connection to the death of Deraek Patrick Larson.
Larson was found dead on playground equipment in Tautphaus Park at 10 a.m. Sunday, Aug. 16. He was found with more than 20 stab wounds on his back, front, neck and head.
No other suspects have been named at this time.
Clark said the court cannot give a preliminary court date at this time, but that one will be given after checking the court’s schedule.
Mitchell is being held in the Bonneville County Jail.
