Trial set for I.F. man accused of trapping, molesting 6-year-old girl
Published atIDAHO FALLS — A trial date has been set for an Idaho Falls man accused of sexually assaulting a six-year-old girl.
James Patrick Kilroy, 31, is facing a felony charge of lewd conduct with a child under 16.
The alleged incident happened in Sept. 2014. According to court documents, Kilroy and his fiancee went to a friend’s Bonneville County home because Kilroy’s water had been shut off due to unpaid bills.
Kilroy told the friend’s six-year-old daughter that he wanted to “play tag” and “the only safe place to play is upstairs,” according to the probable cause statement.
The child’s father was asleep and her mother was in another room doing laundry when Kilroy went upstairs with the girl.
Documents state he “trapped” the child and sexually assaulted her.
The girl repeatedly told Kilroy to stop “so she could go give mommy hugs,” but he threatened that if she told anyone she would be in trouble, according to court documents.
Kilroy and the girl eventually went downstairs where the child went to her mother and said “she had a secret to tell her.” She said her “bad spot” was hurting and told her mother what had occurred upstairs.
The mother told police she demanded Kilroy and his fiancee leave. She then took her child to Eastern Idaho Regional Medical Center where doctors performed a sexual assault exam.
The child told police Kilroy had molested her during a previous incident, but he threatened her not to say anything.
Kilroy is in the Bonneville County Jail. He will face a jury trial on Dec. 1. If convicted, he could face up to life in prison and a $50,000 fine.
Kilroy has an extensive criminal history and pleaded guilty in March to an animals cruelty charge. He was sentenced to perform 20 hours of community service at the Humane Society, but was ordered not to have any contact with mammals.
