Man who asked 9-year-old girl for sex placed on probation

IDAHO FALLS — An Idaho Falls man will spend 15 years on probation after he asked a 9-year-old girl to have sex with him.

Timothy J. Moore, 20, pleaded guilty to one felony count of child sex abuse by soliciting a minor. As part of a plea agreement, Moore will undergo sex offender treatment and be required to live in a group home or assisted living facility until a probation officer recommends he lives elsewhere, according to court documents.

Moore was arrested in June after the victim’s mother called police when she saw text messages on her daughter’s phone from someone talking to her about having sex and sending nude photos.

“Timmy tells (the girl) that she is so hot and that he wants to have sex with her right now,” court documents say. “Tim says that he loves (the girl’s) body…Tim asks for (her) to send a pic of her naked…and says she is his ‘sweet baby girl.’ Tim texts, ‘Love you sexy girl,’ ‘Love you and good nite sexy,’ (and) ‘How is my sexy baby.’”

At the sentencing on Jan. 23, Jason Gustaves, Moore’s public defender, said Moore has several mental health issues possibly from his upbringing and he shows signs of a reactive attachment disorder.

“He came from a very broken home with severe physical and sexual abuse by the biological parents which predicated removing him from the home,” Gustaves said. “Due to his upbringing and perhaps genetics and biology, he has pervasive developmental delays which creates difficulty and improper social and developmental behaviors.”

Gustaves said while Moore was determined competent to stand trial, he does have competency issues due to developmental and intellectual delays.

A constant one on one living situation with adult and child services for Moore has been arranged for while he is on probation.

District Judge Bruce L. Pickett gave Moore a suspended sentence of two years fixed and eight-year indeterminate prison time. Moore will also be required to give 100 hours of community service and register as a sex offender.
