Pocatello man gets probation for displaying gun in front of children
Published atPOCATELLO — A man who pleaded guilty to injuring a child has been ordered to serve probation.
Justin Eugene Stewart, 35, entered the guilty plea to the felony charge after reaching a plea agreement with the Bannock County Prosecutor’s Office, court records show. In exchange, additional felony charges for second-degree kidnapping and aggravated assault were dismissed.
At a Nov. 16 hearing, Magistrate Judge Carol Tippi Jarman suspended 141 days of a 180-day jail sentence, with credit for 18 days served. The final 21 days of the sentence will serve as a discretionary term during Stewart’s two-year period of supervised probation. (“Discretionary jail time” is served at the discretion of the probation officer as a sanction for violating a term or condition of probation, according to the Idaho Supreme Court.)

Stewart was arrested in October following an incident at a home on Bench Road.
Police reports show, Stewart blocked a woman and two children — 5-months- and 19-months-old, respectively — from leaving their home while brandishing a loaded shotgun. The woman told police Stewart was threatening to shoot himself with the gun.
Officers found the shotgun loaded with a single shell.
As part of the probation, Stewart has been ordered to make regular appearances in court for review. He has also been ordered to pay $182.50 in fees and fines.
