Police say Victor man left injured teens at DUI crash and had sex with 13-year old crash victim

VICTOR — An 18-year-old has been charged with multiple felonies after police say he drove drunk and crashed, leaving multiple injured passengers, then fled the scene to have sex with a 13-year-old.

Josser Omar Ruiz Luna is charged with felony lewd conduct with a child under 16, felony leaving the scene of an accident resulting in injury and misdemeanor reckless driving.

According to court documents, on Nov. 9, around 2:20 a.m., Teton County Sheriff’s Office deputies responded to an area near a field located west of 500 West in Victor.

When they arrived, they saw a gold 2008 Cadillac DTS that had driven off the road about 50 yards into the field.

Police reports say the Cadillac had “significant front end damage and had driven through a tree, yard, and fencing on private property.” Deputies say it was “apparent” that the driver was speeding.

At the crash scene, deputies spoke to two people who said they were the parents of one of the victims of the crash, a 13-year-old.

The parents stated their daughter was found at the crash, drunk and injured, and said they did not know who the driver was.

They told deputies the 13-year-old was not answering her phone, so they went out to look for her and found her at the crash scene with two other injured and drunk teens, according to police reports.

Deputies spoke to the three crash victims, who said they had been with “some older guys and were drinking lots of alcohol” near the area of the crash inside a large shed.

One of the men, later discovered to allegedly be Ruiz Luna, offered to drive the teens home. One of the victims stated he “lost control and crashed on the road.”

All three crash victims were taken to the hospital due to their injuries.

Later, the deputy went to the home of the registered owner of the vehicle, who said they were not aware their car had been in a crash but said Ruiz Luna had been driving it and he came home at 5:30 a.m. with another 13-year-old victim, who had also been in the crashed vehicle.

The car’s owner brought the deputy to Ruiz Luna, who was reportedly lying in bed with the 13-year-old victim.

Ruiz Luna reportedly admitted to drinking with the teens before driving the Cadillac, saying he was trying to take everyone home, but the “brakes went out on the vehicle.”

When asked why he didn’t call 911 and why he “abandoned the other three girls at the scene when he knew they were injured,” Ruiz Luna admitted he was intoxicated and stated that he “panicked and did not know what to do.”

He also allegedly told the deputy that he had sex with the 13-year-old that night.

Ruiz Luna was arrested and booked into the Jefferson County Jail on a $35,000 bond. A no-contact order was issued for the victim, and Ruiz Luna is expected to appear for a district court arraignment on Dec. 17.

If convicted, he could face up to life in prison.

Though Ruiz Luna has been charged with these crimes, this does not necessarily mean he committed them. Everyone is presumed innocent until proven guilty.
